terms and conditions

By commissioning me, you are agreeing to the terms listed below.

 

deliverables

  • The client will receive a complete website designed with their brand aesthetics or personal choices in mind as noted in the consultation.

  • If the client needs assistance with minor changes and additions after publishing, the designer will complete them within 72 hours of notification, free of charge.
     

    • Minor changes include, but are not limited to:
       

      • Adding a character to the character wall

      • Adding a demo reel

      • Replacing images

      • Changes to the text
        ​​

  • If the client needs assistance with major changes and additions after publishing, they must consult with the designer for fees and estimated timelines.
     

    • Major changes include, but are not limited to:​
       

      • Adding a new page

      • Changing the arrangement of one or more sections on one page

      • Adding another section

      • Changing fonts and/or color schemes

      • Updating the overall design​

 

timeline

  • A consultation will be scheduled at the convenience of the designer and the client.

  • After the first payment has been received and all necessary materials are uploaded by the client to the Google Drive folder, the designer will complete a first draft of the desktop version within 14 days. See delays.
    ​​

  • After the second payment has been received and the desktop version has been approved by the client, the designer will complete the mobile version within 48 hours.
     

  • The site will be published live immediately after the mobile version has been approved by the client and the basic SEO has been set up by the designer.
     

  • If the client requests a deadline of fewer than 14 days, an additional fee of 10% of the final quote per day shorter than 14 days will be added to the total invoice (for example: 10-day deadline = %40 extra fee, 2-day deadline = 120% extra fee, etc.)

 

use and ownership

  • The client will have full ownership of the completed website.
     

  • A "Website designed by Maddie Matsumoto" notice will be added at the bottom of the footer in no larger than 16 pt font. This will include a link to the designer's website: https://www.maddiematsumoto.com/
     

    • The client may request to remove the notice for a $50 USD fee at any time during or after the design process.
       

  • The designer may use the website (by links, screenshots, and screen recordings) for promotional purposes on their portfolio and social media.
     

    • The client may request to not use their site for promotional purposes for a $50 USD fee at any time during or after the design process.

payment

  • Payment will be made via PayPal invoices. A link to the invoice will be sent to the client immediately after the consultation.
     

  • First Payment:
     

    • A minimum of half of the total amount owed will be requested after the consultation concludes, and must be fulfilled before the designer begins working on the desktop version of the website.
       

    • The client may choose to pay more than half upfront.
       

    • Discount offers will be applied when the invoice is issued.
       

  • Second Payment:
     

    • The second half of the payment (or whatever is left) will be required before the designer begins working on the mobile version of the website.

    • Additional payment will be required for major changes after the initial invoice was created. These fees will be added to the invoice and included in the second invoice.

 

refunds

  • First Payment:
     

    • If the client has made the first payment (regardless of whether they paid half the invoice or more) but has NOT submitted all of their materials to the Google Drive folder, then they may request a full refund within 72 hours from when the payment was made.
       

      • After 72 hours and up to 7 days have passed, the client may request a partial refund of 50% of the amount paid.

      • After 7 days and up to 30 days have passed, the client may request a partial refund of 25% of the amount paid.
         

      • After 30 days have passed, partial refunds will not be granted.
         

    • Refunds for the first payment (regardless of whether the client paid half the invoice or more) will not be granted if the designer has already begun working on the desktop view.
       

  • Second Payment:
     

    • Refunds for the second payment will not be granted.

 

delays and holding

  • After the consultation, the client is guaranteed a spot on the queue for 90 days. This allows the client to pay the first half of the invoice (see Refunds), as well as gather the materials they want to feature on their website within 90 days of the consulatation.
     

    • The designer will check in with the client once every 30 days, at a minimum.
       

    • It is the client's responsibility to notify the designer of cancelations as soon as possible so that the designer may free up an empty spot on the queue.
       

    • If the designer has not been notified and 90 days have passed, then the client will automatically be removed from the queue.
       

  • If any delay occurs during the design process at the fault of the designer, then the designer must notify the client.
     

    • Delays that extend past 7 days after the agreed-upon deadline will result in a refund of 10% of the amount due per day.

    • If the designer must cancel the order due to extreme and emergency reasons, then the design is scrapped and the client will receive a full refund of the amount paid.
       

      • If the client wishes to keep the design for themselves or another designer to work with, then they will receive a refund equal to the amount of work remaining if they have paid a higher percentage of the total invoice than the amount of work completed.

        • Example 1: If the client has paid 50% of the invoice and 30% of the work has been completed, then the client will be refunded 20% of the total invoice.
           

        • Example 2: If the client has paid 50% of the invoice and 80% of the work has been completed, then the client will not receive a refund due to the amount of work completed exceeding the amount paid.

 

denying service

  • The designer may refuse service to anyone under any circumstance.
     

  • The designer WILL NOT engage with materials containing the following for purposes outside of education (including, but not limited to):
     

    • Racism, sexism, homophobia, transphobia, etc.​

    • Criminal activity

    • Pedophilia

    • Abuse

    • Self-harm

    • Pornography (unrelated to NSFW work)
       

  • If it is discovered that the client is harmfully promoting the above or includes them on the site during or after publishing, the designer will immediately terminate their involvement with the website.
     

    • Absolutely no refunds will be granted. All services will be denied.
